Introducción

En esta sección, se ofrece una variedad de recursos que ayudan a comprender los fundamentos esenciales sobre los cuales se estructura la contratación pública en Costa Rica basados en la Ley General de Contratación Pública. Estos materiales incluyen normativas, directrices y estudios que delinean el marco legal y operativo que rige estos procesos.

Es fundamental conocer estos principios, ya que proporcionan claridad sobre cómo funcionan las licitaciones, los procedimientos de adjudicación y los derechos y obligaciones de los participantes. Además, se presentan ejemplos prácticos que ilustran la aplicación de estas bases en situaciones reales, facilitando así un mejor entendimiento para todos los interesados en involucrarse en la contratación pública.

Nuestra propuesta separa la contratación pública en dos momentos: a) Las licitaciones: Todo lo que acontece antes de estar frente a un contrato ejecutable; y b) Los contratos: Todo lo relacionado con la ejecución del contrato.

Las licitaciones

Esta es la parte más amplia, ya que abarca todo los que debe estar presente desde el momento que surge una necesidad administrativa, hasta momento en que se obtiene o rechaza el refrendo.

Es decir, aquí encontrará temas referentes a los motivos que inspiraron el cambio de paradigma de la ley, sus principios, reglas de planificación y elaboración de los pliegos cartelarios y su publicación y eventuales modificaciones, reglas para las ofertas su estudio y subsanación, hasta llegar al acto final y la consolidación del contrato.

Para estos fines los análisis y exposiciones se concentrarán en la información que surge desde el año 2023, pero no se limita y se considera información de otros años que sea valiosa para su consideración.
